NOTICE is hereby given that by virtue of an execution issued out of the office of the Clerk of the Circuit Court of Morgan county, Ind., in favor of Norman T. Cunningham, administrator of the estate of Jas. Cunningham, deceased, and against W.H. Spencer, et al, and to me directed, I have levied upon and will, on Thursday the 27th day of May, 1858, between the hours of 10 o'clock, A.M. and 4 o'clock P.M., of said day, at the Court House door, in the town of Martinsville, county and state aforesaid, proceed to sell at public auction, the rents and profits, for a term of years not exceeding seven, of the following described Real Estate, to wit: Being a part of the northeast quarter of the northwest of section 33, town 13, north of range 1, east-- beginning at the northeast corner of said quarter, and thence running south 19 chains and 75 links to the southeast corner of said qr; thence west 3 chains and 72 links; thence north 10 1/2 deg. west 7 chains and 75 links; thence north 31 degrees, west 6 chains; thence south 77 degrees, west 9 chains; thence south 68 deg., west 3 chains and 35 links; thence north 10 chains and 50 links to the northwest corner of said piece of land; thence east 20 chains and 22 links to the place of beginning, said piece containing 22 acres and 1500's, more or less, situated in Morgan county; and should said rents and profits not sell for a sum sufficient to satisfy said execution and costs, I will at the same time and place, at public auction, proceed to sell the fee simple and interest of the defendant in and to said real extate, or so much thereof as will be necessary to satisfy execution and costs, without any relief from valuation or appraisement laws.
