I, JACOB S. HARRIS, of Owen County State of Indiana, being of sound and disposing mind and realizing the uncertainty of life and the certainty of death; do make and publish this my last Will and Testament. ITEM 1: It is my will that after my death all my just debts and funeral expenses shall be paid out of the assets of my estate. ITEM 2: I give and bequeath to my daughter MARGARET, five hundred dollars to be paid out of the proceeds of my estate, over and above her share hereinafter bequeathed to her and over and above the salary of one dollar per week I am now paying her as a salary for keeping house and caring for me. ITEM 3: It is further my will that after my death and the payment of all my just debts, funeral expenses and the above specific bequest; that all my property both personal and real be sold by my Executor and converted into money, and the remainder of my estate after paying the expenses of the execution of this my Will, shall be divided equally between my following named children to wit: my sons PHILLIP, JACOB J. and JOHN and my daughters CATHARINE, JULIANN, MARY, ELIZABETH, ADA, ROSY and MARGARET, share and share alike. Provided however that in case either of my said children should die before the final execution of this Will then in such case; the share of him or her shall descend and be paid by my Executor to his or her children surviving in equal portions and in case either of my children should die without issue before the final execution of this Will; then in such case his or her share (as the case may be) shall be divided between the remainder of my surviving children above named, equally share and share alike and to the surviving children of those that are dead in equal portions that is the children of those that are dead shall be entitled to the share that the father or mother would be entitled to if living. ITEM 4: I constitute and appoint my son in law, CHRISTIAN WILLEN, Executor of this Will with full power to sell and dispose of all my property both personal and real at private or public sale and on such terms as he may deem to be the best interest of my estate and make distribution of the proceeds as herein provided. FREE, one of the subscribing witnesses to the within and foregoing last Will and Testament of JACOB S. HARRIS late of said County, deceased, personally appeared before LOUIS SCHMIDT clerk of the Circuit Court of Owen County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath declared and testified as follows, that is to say: That on the 27th day of March, 1912 he saw the said JACOB S. HARRIS sign his name to said instrument as and for his last Will and Testament, and that the said instrument in writing was at the same time, at the request of the said JACOB S. HARRIS, and with his consent, attested ans subscribed by the said JOHN W. FULK and WM. M. FREE in the presence of said testator, and in the presence of each other as subscribing witnesses thereto, and that the said JACOB S. HARRIS was at the time of signing and subscribing the said instrument in writing as aforesaid, of full age (that is, more than twenty-one years of age), and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes; and further deponent says not. HARRIS departed this life in said County, testate, as he believes, on the 10th day of March, 1914; that said JACOB S.
